Terms and conditions of sale

These Terms and Conditions govern the purchase and sale of goods, delivery, returns, use of gift vouchers, and the processing of personal data in the electronic store www.liliumparfum.com. This document has been prepared in accordance with the laws of the Republic of Lithuania and the established e-commerce practices of niche perfumery.

 

1. GENERAL PROVISIONS

 

1.1. The Seller is MB “Ukas” (hereinafter – the Seller), engaged in the online sale of author perfumes, perfume samples, and gift vouchers.

 

1.2. The Buyer is a natural or legal person purchasing goods in the Seller’s online store.

 

1.3. These Terms are binding on all Buyers and apply to every order placed in the Liliumparfum.com online store. By placing an order, the Buyer confirms that they have read these Terms and agree to comply with them.

 

1.4. A purchase–sale contract is deemed concluded from the moment the Buyer places an order and pays.

 

1.5. By placing an order in the Liliumparfum.com online store, the Buyer confirms that they have familiarised themselves with the Terms.

 

1.6. The right to order and purchase goods in the online store www.liliumparfum.com is granted to legally capable adults; minors aged 14 to 18 only with the consent of their parents or guardians; and legal entities. Consumer rights provided in these Terms (return of goods and withdrawal from the contract) do not apply to legal entities – they may return goods only on the grounds established by Lithuanian law.

 

1.7. Upon conclusion of the contract, the information provided by the Buyer at the time of ordering (assortment, quantity, price, delivery time, etc.) becomes binding on both Parties and may be changed only in the manner set out in these Terms. Each order is stored in the Seller’s database in accordance with established procedures.

 

1.8. The Seller reserves the right not to confirm the Buyer’s order and to terminate the contract if the Buyer fails to provide all required data necessary to fulfil the order, if fraud is suspected, or for other lawful reasons. The Seller shall inform the Buyer of such a decision within a reasonable time. If an order is cancelled after payment, the Seller shall refund the amount paid within 14 days.

 

1.9. If the Seller is objectively unable to fulfil an order (for example, due to out-of-stock goods or an obvious pricing error), the Seller shall immediately inform the Buyer by email or phone and offer an alternative product or refund the amount paid within 5–14 business days if payment has already been made.

 

2. The Seller reserves the right to amend or update these Terms at any time. The new version shall apply from the date of its publication.

 

2. PRODUCTS AND THEIR NATURE

 

2.1. The following product categories are sold in the www.liliumparfum.com online store:

• author perfumes;

• perfume samples;

• physical gift vouchers;

• electronic (digital) gift vouchers.

 

2.2. Perfumes and samples are classified as cosmetics and hygiene products and are subject to special restrictions regarding returns and withdrawal from the contract.

 

2.3. Product descriptions are provided for informational purposes only. Fragrance perception is subjective; therefore, if a scent does not meet individual expectations, this shall not be considered a product defect.

 

 

3. PRICES AND PAYMENT

 

3.1. All prices are stated in euros (EUR) and include applicable taxes.

 

3.2. Delivery costs are not included in the product price unless expressly stated otherwise at the time of ordering.

 

3.3. The Buyer may pay by:

• electronic banking;

• payment card;

• gift voucher;

• payments can be made via the electronic banking services of “Swedbank”, SEB, “Luminor”, “Citadele” and “Šiaulių bankas”. Payments are available in euros. Payments are processed via the MakeCommerce.lt payment platform.

 

3.4. Order processing starts only after full payment for the goods has been received.

 

4. DELIVERY OF GOODS

 

4.1. Goods are delivered within the territory of the Republic of Lithuania and to foreign countries.

 

4.2. Delivery methods:

• parcel lockers;

• international registered shipping.

 

4.3. Goods are usually dispatched within 1–5 business days after payment is received.

 

4.4. International delivery time depends on the destination country and the selected carrier.

 

4.5. The Buyer must provide accurate delivery details. The Seller is not responsible for undelivered or delayed shipments due to incorrect information provided by the Buyer.

 

4.6. If, at the time of delivery, the Buyer refuses to accept the goods without a valid reason, the Buyer must cover the costs of returning the goods to www.liliumparfum.com. The Buyer must immediately inform the Seller if they refuse to accept the shipment.

 

4.7. The risk of accidental loss or damage to the goods passes to the Buyer from the moment the Buyer or their authorised representative accepts the goods. The Buyer must inspect the shipment upon delivery. If damage to the packaging is noticed, the Buyer must note it on the delivery document and, where possible, draw up a damage report in the presence of the courier or the Seller’s representative. If these actions are not taken, any subsequently discovered damage to the outer packaging shall be deemed to have occurred after the goods were handed over to the Buyer, unless it is the result of a manufacturing defect.

 

5. RIGHT OF WITHDRAWAL AND RETURNS

 

5.1. General right
 

5.1.1. A consumer has the right to withdraw from a distance purchase–sale contract within 14 days, except in cases provided for by law.

 

5.1.2. Return procedure: the Buyer must complete the designated goods return form and submit it to the Seller by email. It is recommended to attach photos of the returned product demonstrating that the product and its packaging are intact and unused. Upon receiving the Buyer’s return notice, the Seller shall confirm receipt within 2 business days and coordinate return details (return shipping address, courier service, etc.).

 

5.1.3. Returned goods must be unused and in their original, undamaged packaging. The Buyer may exercise the 14-day right of return only if the goods have not been damaged or used and if they retain their commercial appearance (intact packaging, labels, etc.). The Buyer must keep proof of purchase until the return period expires.

 

5.1.4. The Buyer returns goods to the Seller at their own expense and risk (unless the Seller states otherwise). After receiving the returned goods and confirming they meet the return conditions (unused, undamaged), the Seller shall refund the product price within 7 business days to the Buyer’s indicated bank account. Return shipping costs: the Buyer generally bears the cost of returning non-defective goods (unless the Seller states otherwise). The initial delivery costs paid by the Buyer are refunded; however, if the Buyer chose a delivery method more expensive than the least expensive delivery option offered by the Seller, the additional delivery costs are not refunded.

 

5.1.5. If it is determined that the returned goods were used, damaged, the packaging was damaged, or the goods are incomplete, the Seller has the right to refuse the return and not refund the payment. The same goods may be sent back to the Buyer unless otherwise agreed. In such case, shipping costs are borne by the Buyer.

 

5.2. Exceptions for perfumery products

5.2.1. In accordance with Article 6.228¹⁰ of the Civil Code of the Republic of Lithuania, perfumes and other cosmetic products whose packaging has been opened or damaged are not returnable due to health and hygiene reasons.

 

5.2.2. Opened, used, or tested perfumes and samples are not returnable and not exchangeable.

 

5.2.3. Returns are possible only if the product:

• has not been used;

• has fully intact original packaging;

• is in the same condition and complete set as when received.

 

5.3. Defective goods
 

5.3.1. If the Buyer receives goods that are clearly defective or damaged during transportation, the Buyer must inform the Seller within 24 hours of receipt.

 

5.3.2. Upon confirmation of the defect, the Seller shall, at its discretion, replace the goods or refund the amount paid.

 

5.3.3. The customer has the right to withdraw from the contract and return the goods within 14 days of receiving them without stating a reason only if:

• the purchased goods are unopened from their original packaging and unused;

• the packaging is not damaged and/or the sticker confirming online purchase is not damaged;

• the goods and their packaging have not lost their commercial appearance and are complete.

The customer acknowledges and accepts the risk that, due to the type and nature of the goods sold in this online store, the goods cannot be tested if the customer wishes to return them without stating a reason; therefore, the goods may not be opened or tested if the customer intends to return them without cause.

 

• The customer must express the wish to return goods by sending an email to: info@liliumparfum.com, indicating the goods to be returned, their name and surname, order details in this online store, and their bank account details. The customer delivers the goods to the agreed address at their own expense or covers delivery costs to the previously indicated address. After the goods are returned, within 10 business days from the return date, the price of the returned goods (excluding delivery costs) shall be paid to the customer’s indicated bank account.

 

5.3.5. Goods may not be exchanged and their price may be refunded to the customer if the Seller no longer has the goods requested for exchange.

 

5.3.6. Under these Terms, goods returned to the Store are defined as complete perfume boxes in original packaging.

 

6. GIFT VOUCHERS

 

6.1. Gift vouchers are valid only in the Liliumparfum.com online store.

 

6.2. Gift vouchers are single-use, have a specified validity period, and are not redeemable for cash.

 

6.3. Electronic gift vouchers are considered digital content and are activated immediately after payment.

 

6.4. Any unused value after the voucher expires is not refunded.

7. LIABILITY

 

7.1. The Seller is not responsible for delivery delays or failure due to actions of third parties (couriers, postal services).

 

7.2. In the event of damage, the party at fault shall compensate the other party for losses in accordance with the laws of the Republic of Lithuania.

 

7.3. The Buyer is responsible for the accuracy and security of the data provided in the order or registration form. If the Buyer provides incorrect data or allows other persons to use their data, the Seller is not responsible for the consequences and has the right to recover from the Buyer any direct losses incurred as a result.

 

7.4. The Parties are released from liability for total or partial failure to fulfil obligations under these Terms due to circumstances beyond their control which could not reasonably have been foreseen and could not have been prevented, as well as their consequences. Force majeure circumstances are understood as defined in Article 6.212 of the Civil Code of the Republic of Lithuania and in the Rules approved by a Resolution of the Government of the Republic of Lithuania on exemption from liability in the event of force majeure.

8. PRIVACY POLICY

 

8.1. The Seller processes only personal data necessary for order fulfilment and compliance with legal obligations:

• name and surname;

• email address;

• phone number;

• delivery address;

• limited payment information.

 

8.2. Personal data is disclosed only to:

• payment service providers;

• delivery service providers;

• public authorities where required by law.

 

8.3. Payments in the online store are processed via the makecommerce.lt platform, operated by “Maksekeskus” AS (Liivalaia 45, Tallinn 10145, Estonia, reg. no. 12268475). Therefore, your personal information required to execute and confirm the payment will be transferred to “Maksekeskus” AS.

 

8.4. The Buyer has the right to access their personal data, request correction or deletion, and to lodge a complaint with the State Data Protection Inspectorate.

 

9. FINAL PROVISIONS

 

9.1. These Terms are governed by the laws of the Republic of Lithuania.

 

9.2. All disputes shall be resolved by negotiation; failing agreement, disputes shall be settled in the courts of the Republic of Lithuania.

 

9.3. The Terms enter into force from the date of their publication in the www.liliumparfum.com online store.

 

9.4. By agreeing to these Terms, the Customer gives consent and expresses the wish to receive our offers and/or newsletters and/or other information by email provided when placing orders, registering in this online store, or subscribing to offers/newsletters/other information. The Customer may opt out at any time by informing us via email at info@liliumparfum.com or by clicking the relevant link in an offer/newsletter/other information email.

 

9.5. The Seller has the right, at its discretion, to supplement or amend these Terms and other documents related to the Terms. Additions or amendments enter into force from the date of publication on www.liliuparfum.com.

 

9.6. The Terms are prepared in accordance with Lithuanian law; Lithuanian law applies to relations and disputes arising therefrom.

 

9.7. Any disputes between the Buyer and the Seller arising from these Terms shall be resolved by negotiation. If no agreement is reached within 45 days after the dispute is initiated, disputes shall be resolved in accordance with the procedure established by Lithuanian law.

 

9.8. The Buyer may submit a complaint regarding purchased goods to the State Consumer Rights Protection Authority; however, as required by applicable law, the Buyer must first contact the Seller.
